Abstract

This paper analyzes the influence of Tahar Haddad (1899-1936) on the Code of Personal Status or Tunisian family law as a basic rights and freedom for Tunisian women since Tunisia’s independence in 1956. Tahar Haddad is a religious scholar who fought for women’s rights and his ideas underlies women’s rights movement in Tunisia. This paper will discuss the condition of women in the early 20 th century Tunisia, his views on women and Islam in his book Our Women in Law and Society, his influence on Tunisian Code of Personal Status, and the impact of the Code of Personal Status to the development of women’s rights in modern Tunisia. The purpose of this paper is to highlight Tahar Haddad’s view on women and Islam and to analyze his influence on Tunisian Code of Personal Status. This paper shows that Tahar Haddad’s views influenced the drafting of Tunisian Code of Personal Status in 1956 and indirectly affected to the basic rights and freedom that Tunisian women enjoyed and consequently created modern Tunisia with the highest degree of equality and freedom for women in the Arab world.
