Abstract

AbstractThe types of private legal rights (intellectual property rights) available for inventors and breeders for their contributions to agricultural technology are described. The most significant legal rights to the results of agricultural breeding and research programmes can be categorized as: trade secret rights; plant patent rights; plant variety protection certificate rights; and utility patent rights. Focusing on the situation in the USA, a brief comparison with selected other country systems is included. Reference is made to a hypothetical plant breeding and research company to illustrate the various legal rights and their applicability to different contributions in plant technology developments.
