Abstract

Midwives have a duty to respect the confidentiality of information they receive from the women they care for. This duty derives from several sources — the contract of employment; the Professional code of practice, duty of care at common law (Furniss v Fitchett, 1958) and as part of the trust relationship with clients. In addition, some legislation imposes specific duties in relation to confidentiality (Department of Health, 1996). The Department of Health has also encouraged NHS trusts to raise standards of confidentiality by the appointment of Caldicott Guardians (NHS Executive, 1999).
