Abstract

Law, justice, and the social contract impose on each person a standard of care. Each person has a duty to behave and perform responsibilities in line with the requisite standard of care expected of an individual in a particular circumstance. Falling below the standard of care results in liability. Criminal liability usually results when a person behaves in a manner that is criminally negligent, reckless, wanton, knowing, or intentional; and that breach causes harm. In general, people have a duty to behave reasonably. Duty changes according to a person’s role in a given circumstance. Certain relationships create additional duties; thus, the standard of care is raised.
