Abstract

DOI: 10.1590/2179-8966/2017/24970 Resumo O presente trabalho pretende abordar de forma panorâmica o pensamento do jurista Otto Kirchheimer. Em um primeiro momento, busca-se relacionar o pensamento do jurista com a tradicao da Teoria Critica da Sociedade – conhecida tambem como “Escola de Frankfurt” -, cuja influencia e marcante ao longo de toda sua producao academica. Posteriormente, o foco residira na critica que Kirchheimer faz ao direito penal nacional-socialista enquanto instrumento de eliminacao dos adversarios politicos. Por fim, a partir da tipologia construida por Kirchheimer no texto “Justica Politica”, serao abordadas possiveis contribuicoes do pensamento do jurista alemao ao contexto juridico atual. Palavras- chaves: Justica politica; Nacional-socialismo; Teoria critica. Abstract This work aims to provide an overview of the juristic thinking of Otto Kirchheimer. At first, will be tried to relate Kirchheimer’s thought with the tradition of Critical Theory of Society - known as Frankfurt School - whose influence is striking throughout his academic production. Later, the focus will lie in the critic that Kirchheimer made against the National Socialist and his criminal law as instrument related to the elimination of political opponents. Finally, considering the typology built by Kirchheimer in the text Justice, will be discussed the possible contributions of his thinking in the current legal context.
