Abstract

The aim of this paper is to look into the changes that have been brought through the recent amendment to make it more market compliant thereby safeguarding the interests of the original author. In the backdrop of latest amendment, there has been substantial amendment with regard to copyright in literary works which favors the legitimate rights of the authors of the literary works with some reasonable restrictions. However, the amendment to section 18 with regard to assignment of the literary works necessitates that the author of the literary work shall not assign the right to receive royalties from the utilization of such work in any form other than as part of the cinematographic film or sound recording except to the legal heirs and the copyright society. Any agreement made in contravention to this shall be void. Further in section 19 (8) there has been explicit mention that any assignment in contravention to the rights assigned to the copyright society to which the author is a member shall be void.
