Abstract

The enactment of the Law No. 21/2014 on Geothermal replacing the previous Law No. 27/2003 on Geothermal reinforces the state’s political will to develop geothermal energy sources as renewable energy to sustain the 35.000 MW power plants programme and eventually the national energy security. By using ‘gaps in governance’ concept as an analytical tool, this literature review study, supported by related data collected from the geothermal bill consideration process in the parliament in 2014, found that the new legal framework has not shown any significant impact to trigger the geothermal development and the 35.000 MW power plants programme. Several ‘gaps in governance’ untapped such as gaps in knowledge, normative, institutional and compliance aspects may become factors to enable the new legal framework not as expected. It is therefore the government should strengthen its political will to enforce the new law as well as its sets of statutory regulations in frameworks of normative, institutional, and resources aspects needed.
