Abstract

The rationale and the legitimacy of punishment are barely reflected in the public discussion on the toughening of criminal law; this is also true for the emerging system of international criminal justice, in particular the International Criminal Court (hereinafter «lCC »). this contribution is an attempt to fill- or at least diminish - this gap on the basis of the domestic theories on the purposes of punishment.
