Abstract

The search for the optimal model of the Constitutional Assembly has been going on since the adoption of the Constitution of the Russian Federation of 1993 and is the subject of discussions of constitutionalists, theorists and practitioners. The article analyzes the origins and domestic originality of the political and legal nature of constituent power, a number of basic approaches to its institutionalization. The emphasis is on understanding the role of democracy in the constitutional and legal space that forms the modern Russian statehood.
