On the Concept and Essential Characters of the Academic Plagiarism as Infringement of a Copyright

Abstract

The article deals with one of the most pressing issues that is the most acute and vigorously discussed in the scientific community - academic plagiarism. It has become an international problem of the contemporary sphere of intellectual and creative activity. The negative impact of plagiarism is manifested precisely in violation of the legal rights and interests of creators, individuals who are authors of certain intellectual property objects. It is academic plagiarism that is one of the catalysts for reducing the quality of published scientific results and, in a way, the deterioration of the scientific field and the intellectual component. Despite the fact that a new Law on Higher Education was adopted in 2014, which enshrined the concept of “academic plagiarism” at the legislative level, the Law focused on dissertation. Student scientific, course and qualification works, as well as monographs, articles and textbooks of scientists were left unaddressed. The article summarized and summarized the main types of academic plagiarism based on the achievements of representatives of the Western scientific community. In particular, the following types of academic plagiarism were distinguished: Elephant; Ctrl + C and Ctrl + V; Find-replace; Remix; Recycle; Hybrid; Mashup; 40 ERROR. In total, by analyzing the academic plagiarism provisions that prevail among members of the scientific community, six main features or characteristics of academic plagiarism have been identified. So. One of the main features of academic plagiarism has been recognized by its very existence - the scientific or academic plane. Another key feature was the attribution of authorship to others 'results of intellectual, creative activity, which is carried out in the form of the publication of others' results of intellectual, creative activity under the name of a person who is not its author. The next feature that was highlighted is the object. It has been determined that the violation may be committed in relation to dissertations, scientific articles, monographs, etc. Another feature is a derivative of a kind of academic plagiarism. In particular, this feature is the method of academic plagiarism. And the last sign of academic plagiarism, in our opinion, is the consequences of its detection.
