On state funds and other measures to stimulate industry

Abstract

The article considers certain measures to stimulate the economy, the mechanisms of which are reflected among other things in the Concept of Technological Development for the Period up to 2030, and also proposes possible ways to increase their efficiency. The issues of creating state funds by the Russian Federation are being investigated, which, by virtue of paragraph 3 of Article 213 of the Civil Code of the Russian Federation, are privately owned. The integrated structure of the military-industrial complex is disclosed, as the cooperation of the head and other executors of the state defense order, based on defense legislation, and to which the norms of Article 673 of the Civil Code of the Russian Federation on subsidiary economic companies do not apply. It is proposed to rethink the provisions of paragraph 3 of Article 2 of the Civil Code of the Russian Federation, interpreting them in such a way that civil law applies to property relations based on administrative or other power subordination of one side to the other, unless otherwise expressly provided by law. The proposed approach will avoid different definitions of the essence of such a phenomenon as public ownership in entrepreneurship and will ensure the uniformity of judicial practice.
