Abstract

Classical criminalistic methods, despite the high level of development, have proven to be ineffective in combating organized crime. The reason for this are the characteristics of organized crime. Therefore, it was necessary to develop and constantly improve new tools and modes of operation that will adequately respond to the challenges of combating organized crime. As well as other modern criminal procedure legislations, our legislature has allowed the application of special evidentiary actions. The results achieved by their application are not negligible. The same is true for problems related to their practical application and legal solutions. One of the special evidentiary actions is undercover agent. In the paper it will be shown some characteristics of special evidentiary actions and the undercover agent. Aim and the main part of paper is a detailed analysis of the legal and theoretical solutions related to the responsibility of the undercover agent for the criminal acts in a criminal organization. Also, it will be showed the legal solutions in certain foreign jurisdictions.
