Abstract

The article provides a comprehensive analysis of the essence and legal characteristics of occupational medicine insurance. This is a relatively new insurance product in the Polish market which addresses the need to protect the employers’ risks related to occupational medicine, in particular the obligation to bear the costs of medical examinations and of preventive health care. The lack of specific legal provisions which would regulate the voluntary medical insurance, including occupational medicine, contributes to the uncertainty about the admissibility of such insurance products. The authors of the article present the legal structure of occupational medicine insurance, including its compliance with the law in force, legal characteristics and place in the insurance scheme. Furthermore, having discussed the basic issues related to occupational health insurance, they indicate the aspects of how this type of insurance operates in practice. Finally, they provide a thorough analysis of a random event, the insurer's compensation and liability in the occupational medicine insurance.
