Abstract

This article focuses on Miguel Reale’s culturalistic and three-dimensional epistemology, which is known as three-dimensionalistic culturalism. It aims to investigate his notion of science of law and whether it can contribute to the advance of the science of law. Thus, fi rstly we focus on the analysis of culturalism and the notion of structure of law, i.e. we investigate Reale’s criterion for the demarcation of the scientific knowledge of law and its object of study. Secondly, we analyze the three-dimensional structure of law proposed by Reale in order to understand his idea of science of law and of norm as a basic object. Thirdly, we attempt to answer the question whether Reale’s view of law and science of law can help to advance the scientific knowledge of law, allowing us to distinguish between scientific and doctrinal research.Key words: legal knowledge, juridical methodology, science of law, three-dimensional theory of law, juridical culturalism, Miguel Reale.

Considerações introdutórias

O jurista e filósofo brasileiro Miguel Reale (19102006) sistematizou a teoria tridimensional do direito, na qual o conceito de Direito se compõe de uma tríade de elementos: (a) o fato; (b) o valor; e (c) a norma. O Direito, por conseguinte, deve ser estudado em sua tridimensionalidade – a Teoria Tridimensional do Direito de Reale –, que é a expressão dos seus aspectos histórico-social, axiológico e normativo, tendo em vista que realiza historicamente um valor por meio de uma norma de conduta que disciplina os comportamentos individuais e coletivos das pessoas em sociedade. Por consequência dessa caracterização epistemológica da Ciência do Direito, a teoria de Reale comporta os elementos fato, valor e norma, constitutivos do Direito, os quais são percebidos como categorias epistemológicas e ingredientes históricos que se constituem da experiência jurídica.
