O dano moral coletivo na sociedade de risco: uma análise de sua funcionalidade no meio ambiente do trabalho

Abstract

EnglishPost-industrial society is called a risk society because of the risks generated by the advance of technology, globalization and the flow of information. In this new context, civil liability,especially that resulting from unjustly sustained damages, takes on the dimension of the community. Thus, the problem faced in the research is to analyze, according to doctrine and jurisprudence, the possibility of conferring moral damages to a collectivity. The methodology employed was the search for specific articles on the subject, as well as judgments of the courts combined with current doctrine. The conclusion is that the collective labor moral damage exists as a result of the risk society and that affects in particular the work environment and therefore the health of the worker, this causes the debate to deepen the environmental law of labor. and that it be seen as an instrument to reduce complexities, serving as a mechanism for protecting workers' health portuguesA sociedade pos-industrial e nominada de sociedade de risco pelos riscos gerados em decorrencia do avanco da tecnologia, da globalizacao e da fluidez das informacoes. Nesse novo contexto, a responsabilidade civil, notadamente aquela em decorrencia dos danos injustamente suportados toma a dimensao da coletividade. Assim, a problematica enfrentada na pesquisa e analisar de acordo com a doutrina e jurisprudencia, a possibilidade de conferir danos morais a uma coletividade. A metodologia empregada foi a pesquisa de artigos especificos sobre o tema, bem como julgados dos tribunais aliado a doutrina atual. Conclui-se, que o dano moral coletivo trabalhista existe em decorrencia da sociedade de risco e que atinge em especial o meio ambiente do trabalho e por conseguinte a saude do trabalhador, isso faz com que o debate propicie um aprofundamento sobre o direito ambiental do trabalho e que este seja visto como um instrumento de reducao das complexidades, servindo como mecanismo de protecao da saude do trabalhador.
