Abstract

The object of this work was to approach the concept of free unfolding of personality and its characteristics, taking as reference the German conception, translated by art 2o of the German Constitution of 1949. Later, we move on to the discussion about the general personality rights, approaching the advantages of the open typicality of personality rights in opposition to the taxi-activity understanding of theses rights. Finally, taking into consideration the practical application of the implications of the concept of free unfolding of personality, and the several possibilities of protection of personality rights, an analysis of the possibilities of violations in personality rights are carried out, in the cases of mobbing or moral harassment, capable of compromise the free unfolding of personality.
