Abstract

This paper aims to discuss about the coming of Linguistic Rights, by analyzing the Universal Declaration of Linguistic Rights, the bills 1676-D/99 (about promotion, protection and defense of Portuguese language), 4610/01 and 438/08 (about the implementation of inclusive language in official documents) and, finally, the new Portuguese language orthographic reform. The Universal Declaration of Linguistic Rights represents an important step for the protection of linguistic communities, by recognizing that the use of the language must be ruled in respect to diversity, coexistence and reciprocal benefits. However, it was concluded that the pretension of establishing manners of use to the language in a previous way is ineffective, because it is dynamic and changeable, not passive to the administration of a linguistic community, academy or state public politics that requires an adaptation of the society through a legal control.
