Abstract

In the XX century, torture was used on a large scale by totalitarian political systems. On the 1960s and 70s, Greece and Spain lived under dictatorships and Latin America was under the domain of military regimes. Brazil lived under an exceptional regime from1964 to 1985. In 1979 with amnesty, political prisoners were liberated but torture continued against the common prisoners. In 1984, the UN edited the Convention against torture stimulating member countries to create penal codes in their legislation. The Federal Constitution of 1988 foresaw major severity in the so-called hedonic crimes, among them, torture. Law 9455 of April 7th, 1997 created the penal code but with imperfections that call for urgent correction.
