NOTION OF NORMATIVE ACTS OF CONSTITUTIONAL COURT OF UKRAINE – SOURCES OF LABOUR LAW OF UKRAINE

Abstract

The article is dedicatedto the definition of normative acts of the Constitutional Court of Ukraine adopted within the process of judicature providing and its operation organization. The author proposes her own classification of these acts. In the article standard acts of Constitutional Court of Ukraine are justified to be the sources of labor law in Ukraine. Constitutional Court of Ukraine carries out its tasks by deciding if laws and other legal acts are constitutional and providing official interpretation of the Constitution of Ukraine and Ukrainian laws. The results of such activities are objectified in the form of the acts of the Constitutional Court of Ukraine. It is proposed to determine acts of Constitutional Court of Ukraine as a set of all acts of the court that are made, within the designated authority. It is importaint to say, that not all acts of the Constitutional Court are normative, and can be considered as sources of law. Normative act of the Constitutional Court of Ukraine is officially published legal act, established in the process of court’s activities in written form, and designed to change of terminate rule of law, predict legal consequences, intended for an unspecified number of uses and is addressed to not personalized range of subjects. It is proposed to categorize all acts of Constitutional Court of Ukraine into two fields: justice acts and acts of organizational support.
