Abstract

This study presents a comparative analysis between North American and European positions as to precaution and suggests some reasons for the divergence on this subject. It also addresses trade-related questions arising from the controversy on the precautionary principle. The conclusion presents the author’s opinion about the meaning of the principle and points out some matters pending further discussion so that the principle can achieve a higher level of effectiveness.
