Abstract
NHL owners' effort to foster discussion between players and NHL executives about the current CBA proposals may have violated federal law. The NHL overstepped the well-established bargaining procedures under the National Labor Relations Act by failing to bargain in good faith with union elected representatives. However, the NHLPA will have to establish acute bad faith bargaining to successfully seek judicial reprieve.
