Abstract

In the November 8, 2022 elections, California voters were presented with two separate ballot measures that would have legalized sports wagering in different forms. Both of the measures failed by wide margins. Two-thirds of voters opposed Proposition 26 (in-person tribal sports wagering), and over 80 percent opposed Proposition 27 (online and mobile commercial-tribal sports wagering). In the immediate aftermath, scrutiny of the measures, the campaigns surrounding them, and their implications for what comes next in California, and nationally, are instructive for the future of tribal as well as commercial sports wagering.
