Abstract

This study constitutes a critical evaluation of the normative content of Art. 90 of the Polish Criminal Code which authorizes the so-called aggregate criminal-law measure in the Polish criminal law. Striving for perfection in the regulations in force – understood in the author’s view as their particular unambiguity and their being based on axiology which merits universal endorsement – requires, with respect to the criticized solution, a presentation of remarks containing postulates. The paper concludes with a presentation of the direction which the new wording of Art. 90 of the Polish Criminal Code should take.
