论联合国人权条约监督机制

Abstract

联合国人权条约监督机制对于人权条约的顺利实施具有重要的意义，其具体运行制度包括缔约国报告制度、缔约国间指控来文制度、个人申诉来文制度以及公约机构调查制度。然而由于诸多因素的影响，联合国人权条约监督机制的实施与实际效果仍有距离，本文拟以联合国系统内人权条约为背景，对国际人权条约规定的联合国监督制度进行评析和展望。 UN human rights treaty plays an important role in implementing human rights successfully; its specific operation system includes the reporting system of the states parties, the system of allegations of communication among the states parties, the system of individual complaints and the investigation system of convention institutions. However, due to the influence of many factors, for the supervision system of UN human rights treaty, there is a long distance between the implementation and actual effect. This article intends to review and forecast the UN system of monitoring the international human rights treaty under the background of the human rights treaty in the UN system.
