Abstract

The Polish Presidency of the Council of the European Union almost succeeded in finalising the work on an international agreement between 25 European Union member states establishing a patent court system which will decide patent infringement cases and patent revocation cases for the future Union Patent and the classical European “bundle” Patent. It was mainly on the question of the seat of the Central Division of the Unified Patent Court (UPC) that unanimity could not been achieved. However, there was still discussion as well regarding some legal and practical questions. The present article seeks to give an overview of these questions and to contribute to their solution.
