Abstract

A discussion on legislation regarding the Crown concerning the right to billet and impose martial law is presented. It is concluded that sections 6,7 and 8 of the Petition of Right 1627 be repealed. The paper also examines the rationale behind the Crown's right to all gold and silver mines in England and Wales. It concludes that the Royal Mines Acts 1688 and 1693 be repealed and that the Crown prerogative in respect of gold and silver mines on other people's land is inappropriate as the rationale for the same no longer exists.
