Abstract

Since the GlueStV 2021 came into force, minimum distance requirements between gambling halls violate German constitutional law. The new treaty allows, among other things, virtual slot machines. At the same time, it provides for stricter access authorisation at the expense of gambling hall operators. The study systemizes the goals pursued by the state legislatures, asks for empirical evidence for the effectiveness of minimum distance requirements, and measures the currently existing regulations against constitutional law. In this way, incoherencies and inconsistencies between the regulation of virtual and terrestrial slot machines are found under European Union law and German constitutional law. Minimum distance requirements interfere disproportionately with the professional freedom of gambling hall operators. The minimum distances should at least be shortened.
