Abstract

Union‐free employers engaged in mergers and acquisitions (M&A) activity, take note. In July 2022, the National Labor Relations Board issued a memorandum of understanding (MOU) with the Federal Trade Commission (FTC) that details collaborative enforcement efforts going forward. The MOU calls for, among other things, “information sharing and cross‐agency consultations on an ad hoc basis for official law enforcement purposes” and “cross‐agency training” of FTC personnel on the National Labor Relations Act.
