Abstract

Civilians operating in the battlefield can easily escape the requirements of being classified as a mercenary under the current international legal regime. By analyzing a hypothetical based on current events in Syria, it is clear that foreign fighters fighting the Assad regime can easily escape the prohibitions for mercenarism under international law. Due to this loose international definition of mercenary, States have and will continue to use contractors to accomplish national security interests in the battlefield without the fear of legal ramifications.
