Abstract

Forensic mental health as an interface between law and psychiatry exists at the intersection of mental health and criminal legislations. Although most countries in Africa have criminal and mental health law statutes relevant to offenders diagnosed with major mental illnesses, there remain those without such legislation. The implementation of such laws, where they exist, is also inconsistent, necessitating best practice guidelines. This chapter will describe the existing mental health laws in African jurisdictions and evaluate their comparability with global benchmarks. It will also compare the mental health statutes specifically related to the assessment and treatment of mentally disordered offenders across African jurisdictions and discuss the broader psychosocial, legal and ethical issues that have arisen from them.
