Abstract

O estudo avalia as práticas punitivas como mnemotécnicas, aproximando a perspectiva filosófica de Nietzsche e a teoria agnóstica da pena. A hipótese desenvolvida na investigação é de que a ritualização e institucionalização dos castigos, através dos primitivos procedimentos penais, atuam como mecanismos de manutenção da memória dos delitos, da “culpa moral” e do “sentimento de dever”. Abstract The study analyses the punishing practices as mnemotechniques, bringing closer Nietzche’s philosophical perspective and the agnostic theory of punishment. The hypothesis developed in the research is that both the ritualized practice and the institucionalization of punishment, through primitive criminal procedures, act as mechanisms of maintenance of the memory of the crime, “moral guilt” and “feeling of duty”.
