He takes instructions from both plaintiff and defendant. In the United Kingdom, experts owe a duty to the court irrespective of which side they are on, whether in preparing expert reports or giving oral evidence. This is so as to avoid conflicts of interest such as no-win-no-fee arrangements, which are prohibited for experts in the United Kingdom.
