Abstract

The author outlines the development in Europe of commercial mediation or Alternative Dispute Resolution as it is widely known in the legal system, and some case studies as well as his experience in leading one of the leading institutions formed to promote this field. He explains how the advantages for the parties in achieving more cost-effective or better outcomes, has helped drive support for the process and how this has translated into business, political and judicial support.
