Abstract
One of the most important consequences of Portuguese discoveries was the black slavery business. A most reputed theologist and jurist of the time, Juan de Molina, who had a first-hand knowledge of the subject, made a thorough analysis of the justness of slavery from a Theology and Law perspective, while showing himself opposed to the same. His doctrine set basis for future thought and he must be considered as the first great tratadist on black slavery.

Summary
Siguiendo a Aristóteles, Molina distingue dos clases de esclavitud: la natural y la legal. La servidumbre natural se deriva de la misma naturaleza, que ha dividido a los hombres en sabios y civilizados e ignorantes y bárbaros. Los primeros están destinados a ser señores de los segundos y éstos a ser siervos de los primeros. Aunque algunos autores la entendieron en sentido estricto, la mayoría interpretaron a Aristóteles afirmando que se trataba de una esclavitud en sentido lato, pues es conveniente y lógico que el sabio gobierne al ignorante y éste se someta al primero, pero libremente y nunca a la fuerza. La servidumbre legal es la que genera esclavitud en sentido estricto, que otorga al dueño dominio sobre el esclavo como cosa propia y al siervo le conduce a la obediencia rigurosa.
