<br>The Arrest and Release of the Foreigner Who Refused to Identify Himself

Abstract

תקציר בעברית: המאמר נסב סביב מקרה של זר, אשר סירב למסור לרשויות מידע אודות שמו הפורמלי ומדינת אזרחותו, ועל כן הושם מאחורי סורג ובריח. בהתבסס על התיאוריה של לואי אלתוסר על מנגנוני מדינה מכניעים ומנגנוני מדינה אידיאולוגיים, נטען במאמר שהתנהגותו הקונטרה-הגמונית של הזר נענתה בתגובה מכניעה מצד מנגנוני המדינה המכניעים, לרבות בית-הדין לביקורת משמורת. הואיל ולמרות פעולות ההכנעה עמד הזר בסירובו למסור את פרטיו המזהים, נטש בית הדין, חמש שנים מאוחר יותר, את האמצעים המכניעים בהם נקט, ובחר בגישה חלופית, על פיה הזר הינו בלתי שפוי. בעשותו כן, ביקש בית-הדין להציל את כבודו: הוא שחרר את הזר (ובכך שירת את האידיאולוגיה הליברלית, המתנהגת למעצר ארוך ובלתי מוגבל בזמן בגין עבירה פעוטה), ובד בבד לא הודה בכישלונם של מנגנוני המדינה המכניעים בטיפול בעניינו. בכך, בית הדין – כמו בית-המשפט העליון בפרשו מטמבו– התחמק מלדון בדילמה עימה נאלצות מדינות ליברליות להתמודד: כיצד לנהוג בזר, המסרב לשתף פעולה עם הרשויות, ובכך מסכל את גירושו שלו? English Abstract: The article revolves around a case of a foreigner, who refused to provide the authorities with his formal name or nationality, and was therefore incarcerated. Drawing on Louis Althusser's theory of Repressive and Ideological State Apparatuses, the thesis in the article is that the foreigner's counter-hegemonic behavior was met with serious repression of the Israeli Repressive State Apparatuses, including the Custody Tribunal. Since despite such repression, the foreigner continued to refuse to identify himself, the Custody Tribunal abandoned – five years later – the repressive measures, and took a different approach, according to which the foreigner was mentally ill. By taking this course of action the Tribunal was able to save face: It released the foreigner (thereby preserving the liberal ideology – opposing the lengthy, unlimited arrest of a person for a minor offence), while not admitting the impotence of the Repressive State Apparatuses. By doing so, the Tribunal – like the Supreme Court in the Metambu case before it – eschewed a serious dilemma that liberal countries have to grapple with: what to do with a foreigner who refuses to cooperate with the authorities, thereby thwarting his own deportation?
