Abstract

IN RECENT YEARS, some jurisdictions across the United States have legalized casinos. Of these jurisdictions, most have opted to limit the number of casinos that will be allowed in the state, either in the enabling gaming control act or in the regulations promulgated by the duly authorized gaming commission of the state. The minority has not put such a limit on the number of casinos in the state, favoring a market approach to the number of casinos. This article will discuss the benefits and consequences associated with these decisions. The first section of the article gives the relevant history of legalized gaming in the United States and explores the differences among jurisdictions with regards to the number of casino licenses allowed in each state. The next section explores the benefits and consequences of limiting the number of casino licenses and is followed by a contrasting section exploring the benefits and consequences of unlimited licensing. Finally, the conclusion summarizes the arguments within this article and offers my suggestion as to which method is more beneficial to a jurisdiction that is considering legalizing casinos.
