Abstract

According to the legal civil code, the permanent functional incapacity is quantified with a percentage established with reference to an indicative or imperative scale. According to their chronology of appearance, we approach in the field of psychiatry, and sometimes neurology, the updated versions of the scales of the Concours Medical and the French Society of Legal Medicine before referring to the Guide Barème Européen. Then, we propose a transversal discussion, which will perhaps allow to understand why the percentage assigned to the permanent functional deficit of the post-traumatic psychic disorders has decreased without discontinuity from one republication to the other of the scales for nearly 50 years.
