Lemon v Kurtzman and the Court's Establishment Clause Jurisprudence

Abstract

This Article discusses the Lemon test used to determine Establishment Clause violations. The three-part Lemon test was an early test articulated by the Court and, after much criticism, was subsequently modified in various ways. This article examines how the Lemon test evolved, how it was applied, and what criticisms were levied against it.
