Abstract

This chapter explores the legislative history of the Parsi community law and evaluates its implications for women’s rights in India. It traces the history of personal laws of the Parsi community and describes the strategies adopted by them to bring in reform. It suggests that the Parsi community negotiated for a separate law only through its political and economic significance during the colonial rule. The liberal leaders of the community have ensured that the law does not lag far behind the dominant social norms of the British, during the colonial rule and of the Hindu in the post-colonial rule. Hence, their claim for a separate law to safeguard women’s rights cannot be substantiated.
