Abstract
The problem of protection of man, his environment, mining wastes, emergencies, natural disasters, catastrophes, including ecological consequences, is an undeniable fact of the present time. Among the problems of special importance for the formation of environmental safety in the Kyrgyz Republic is the development of a legal basis for ensuring the safety of waste storage facilities in the mining industry. At present, along with the introduction of progressive legal regulation of the safety of tailings, it is necessary to highlight the problem of comprehensive reading and research of legal measures and theoretical legal bases of the safety of tailings. Without the development of theoretical and legal foundations, it is a legal phenomenon that it is possible to ensure the ecological safety of mining waste only with the participation of the state and civil society in these matters, regardless of their legal status.
