Abstract

The organizational and legal bases of activity of bodies of system of the Ministry of Internal Affairs on realization of powers in the field of private detective and security activity and arms circulation are investigated. It is determined that the main factor that determines the peculiarity of this area is the increased public danger in the illegal activities of its subjects. It is proposed to create state legal mechanisms to control the implementation of security activities, aimed at ensuring the security of society in particular.It is proved that the organizational and legal basis of security activities should be comprehensive and formed by relevant regulations. Legal regulation of organizational and legal principles of security activities should also cover the activities of the bodies of the Ministry of Internal Affairs on the implementation of these principles. Thus, the mechanism of organizational and legal regulation of the activities of the Ministry of Internal Affairs on security activities should include the development of legal norms within the stages, if formed: the rights of the Ministry of Internal Affairs to control the functioning of the controlled entity; system of informing the controlling body about it; responsibilities of the bodies of the system of the Ministry of Internal Affairs to respond to deviations from the parameters of the functioning of the controlled entity provided by the legislative body.Forms and methods of influence of the bodies of the Ministry of Internal Affairs on the controlled entity in case of deviations from the set parameters of its behavior must be established by law. In particular, in order to ensure the personal security of employees of non-state security structures and create a level playing field for all actors in the security services market, it is important to speed up consideration and adoption by the Verkhovna Rada of Ukraine of the Law on the Right to Civilian Firearms.It is necessary to legislate the Unified State Register of Civilian Weapons and determine the principles of its maintenance. The holder of the Register should be the Ministry of Internal Affairs of Ukraine, which will monitor compliance with the law during registration.Accordingly, the legal regulation of security activities in Ukraine requires a single concept of state policy for the formation and functioning of a competitive market for this type of service. All stakeholders should take part in its development – security structures of all forms of ownership and the Ministry of Internal Affairs equally. At the final stage, it is necessary to resolve at the legislative level the issue of permitting the use of weapons for security activities by non-state security agencies.Currently in Ukraine, only the subjects of legal relations on the provision of security services are covered by the law. The activities of security units of business entities remain outside the scope of legal regulation. Achieving public safety is possible only in the case of effective control by the bodies of the Ministry of Internal Affairs over the implementation of security activities by all its subjects.
