Abstract

In Locking v McCowen (2015 ONSC 4435) the Ontario Superior Court of Justice dismissed a breach of fiduciary duty claim against several Real Estate Investment Trust (REIT) trustees. The decision is problematic because the Court wrongly assigned legal personality to the trust and disregarded the status fiduciary duty of the trustees.
