Abstract

Emotional support animals is a newly market category that refers to the relationship between a human and a nonhuman animal that provides therapeutic benefits of affection and companionship. There is an increasing amount of people who claim to require the emotional support of a nonhuman animal in the development of their daily lives. While this is an emerging theme that requires in-depth studies to define the scope of this interrelation between humans and nonhuman animals, it is important to continue to widen legal perspectives for its regulation under two premises: avoiding any discrimination exercised against people who require the emotional support of an animal and, on the other hand, regulating the work or support afforded by emotional support nonhuman animals to avoid abuse, exploitation or mistratment. One of the first legal approches to the issue could be to assimilate the emotional support activities with the tasks undertaken by disability support animals, so as to expand on this legal category.

NOTA INTRODUCTORIA

El 3 de diciembre de 1889, Federico Nietzsche salió de su casa en Milán rumbo al centro de la ciudad, en el camino observó a un caballo de tiro famélico, exhausto, tirado en el suelo; el cochero golpeaba al jamelgo y lo insultaba para intentar que se pusiera de nuevo en pie. Con la emergencia de esta nueva categoría integrada por los binomios humano-no humano de apoyo emocional, se presenta un área de oportunidad jurídica que es, en primer lugar, el reconocimiento de los animales no humanos de soporte emocional como un nuevo tipo de cooperación en materia de asistencia humana y, en segundo lugar, integrando esta categoría como asimilable o análoga a la de animal de asistencia, para permitir así, una mejor integración de estos binomios a la vida cotidiana. Bajo estas dos premisas, el presente trabajo pretende hacer una aproximación preliminar a esta categoría emergente y determinar cómo la falta de un reconocimiento jurídico adecuado de la misma produce un doble efecto: la discriminación del humano que requiere el apoyo emocional de un animal y las lagunas jurídicas que pueden fomentar el abuso o maltrato de los animales no humanos de soporte emocional. La propuesta del presente estudio es, fundamentalmente, que se reconozca a los animales de soporte emocional dentro de la categoría de animales de asistencia, ampliando el contenido de la misma y permitiendo que los binomios de soporte emocional tengan el mismo reconocimiento y prerrogativas que los binomios de asistencia para personas con discapacidad
