Abstract

Abstract This chapter evaluates the concept of legal capacity and assesses how it is employed in research in historical political economy. It discusses the relationship between legal capacity and state capacity, issues of measurement, and relates the concept to the wider body of research on the rule of law, governance without the state, and legal origins. It uses the concept of legal capacity to shed light on the evolution of legal institutions in medieval England and early modern France.
