Abstract

A legal battle over state inspections, compounded by adverse weather conditions, has delayed Terra Industries' efforts clean up from the Dec. 13 explosion that razed its Port Neal, Iowa, fertilizer complex (C&EN, Dec. 19,1994, page 4). Charging that Terra was hindering its inspections into the cause of the explosion, the Iowa Division of Labor's Occupational Safety & Health Administration (IOSHA) obtained on Jan. 3 a temporary injunction to prevent the destruction of documents and This injunction from the Iowa District Court for Woodbury County forced Terra halt cleanup at the site. On Jan. 9, the court modified the injunction allow Terra move materials after notifying IOSHA and allowing it access evidence.
