Abstract

This chapter aims to contribute with the legal historiography on Portuguese private law during the Early Modern period, particularly on the role of legal authorities in the making of two legal institutes, majorats and emphyteusis. These institutes are used to analyze the close relations between practical literature (decisiones, consilia, allegationes, resolutiones forenses) and the decisions taken by Portuguese royal courts, in order to understand the role of the idea of legal authorities both in case law and legal literature.
