Abstract

The norms of civil law are designed to regulate the relations of participants in civil legal relations arising from the appropriation of property benefits. Subjects of civil legal relations can satisfy their interest in property either through the conclusion of contractual relations, as a result of which the subject will have the right to demand satisfaction of their property interests through the behavior of an obligated person, or by acquiring property rights to the property with its subsequent use. In practice, there are legal relations in which it is very difficult to determine the nature of the rights arising in relation to property. In this article, an assessment of the rights arising from an open joint-stock company in relation to the state property transferred to it for gratuitous use is carried out. The analysis of the content of the contract for the gratuitous use of state property was carried out, the presence of signs of other civil law contracts in it was established. Proposals have been made to adjust the civil legislation.
