Abstract

The Austrian Genetic Engineering Act (Gentechnikgesetz) - GTG (BGB1 Nr. 510/1994) which came into effect on January 1st 1995 deals with the contained use of genetically modified organisms (GMOs), with the deliberate release of GMOs, with placing on the market and the labeling of products which consist of or contain GMOs, with the labeling of products containing parts of GMOs, but - despite all criticism based on concerns regarding the legal system - also with gene analysis and gene therapy on humans. This fact is all the more remarkable as the GTG was initially mentioned only to transform the two EU-Directives 90/219/EEC on the contained use of genetically modified micro-organisms and 90/220/EEC on the deliberate release of genetically modified organisms into the environment. However, these two EU-Directives aim exclusively at securing of the safety of man and environment against any risks which might be caused by GMOs, but do regulate neither gene analysis and gene therapy on humans nor the labeling of products containing parts of GMOs.
