Abstract

Purpose: The purpose of this study is to determine the implementation of the distribution of inheritance in the form of land rights to heirs with foreign citizenship and to find out the factors that become obstacles / constraints and solutions in the distribution of inheritance in the form of land rights to heirs with foreign citizenship.
 Research methodology: The research method used in this research is sociological or empirical legal research which mainly examines primary data such as materials that bind legislation.
 Results: The results showed that the distribution of inheritance in the form of land rights to heirs with foreign citizenship, then foreign nationals can still receive inheritance from foreign national heirs but within one year the heirs must release / transfer to Indonesian citizens or by changing their rights to use rights.
 Contribution: This research provides a comprehensive overview of the legal framework governing the inheritance of land rights by foreign nationals in Indonesia. It also identifies and discusses the key challenges faced by foreign national heirs in the inheritance process.
 Implementation: The findings of this research can be used to inform policymakers, legal practitioners, and individuals involved in inheritance proceedings involving foreign national heirs. Additionally, the research can be used to develop strategies for improving the legal framework and process for inheritance of land rights by foreign nationals in Indonesia.
