Abstract

Many countries in the world establish and support programs of legal aid services to the underprivileged, who, most often, are the indigent. In the People's Republic of China (PRC), after the establishment of the Communist regime in 1949, the Constitution Law and other regulations provided that the criminal defendants were entitled to defense. The PRC authorities claim that the establishment of the Chinese legal aid system will effectively help to guarantee the human rights of indigent people. Some prominent lawyers have proposed rules to require lawyers to take a certain number of legal aid cases, especially criminal defense cases, to fulfill their professional responsibility. Legal services in civil matters are mainly provided to juveniles, elder citizens, women, and other unprivileged persons. The surveys of lawyers and law students reveal that there is a realistic chance of success of the legal aid programs in the PRC if there is appropriate organization and administration of the work.
